Tenant complained of a rent overcharge. Landlord claimed the building wasn't rent-stabilized. The DRA ruled for tenant, and landlord appealed. Landlord claimed the building has contained five apartments since he bought it in 1939. Tenant claimed she'd heard that two apartments were combined into one after the date the building would have become subject to rent stabilization. The DHCR ruled for landlord. The DHCR's rent control records showed that in 1943 the building was registered with five apartments. Subsequent MBR orders also always listed five apartments.
