Landlord applied for MCI rent increases based on pointing and waterproofing. The DRA ruled against landlord, finding that landlord's application wasn't filed within two years of completion of the work. Landlord appealed, claiming that the application was filed on time. The DHCR ruled for landlord. Landlord's work proposal stated that it would pay its contractor as work progressed, with final payment to be made within 30 days of completion of the work. Landlord's final payment was made to the contractor on May 10, 1988, the completion date of the work.
