Apartment Illegally Converted to Four SRO Units

The DOB issued a violation notice to landlord for illegal conversion of an apartment designed for one family to four single room occupancy (SRO) units that contained 23 beds. Landlord claimed that tenant made these alterations without landlord's knowledge or consent. Landlord also had cured the condition. The ALJ ruled against landlord and fined it $9,800. Landlord appealed and lost. Landlord was responsible for the violation, even if it was done by tenant. And the penalty of $800 plus the maximum per-day penalty of $50 per unit for 45 days was proper.
