Tenant complained of a reduction in services because landlord locked the common area holding mailboxes between 10:00 p.m. and noon the next day. Tenant claimed she should have 24-hour access to the mailroom. Landlord claimed it had always denied access to the mailboxes during these hours for security reasons. The DRA ruled for tenant, and landlord appealed, claiming that the mailroom had been open only from noon to 10:00 p.m. since before the ETPA went into effect. The DHCR ruled for landlord. Landlord's base date service was 10-hour access to the mailroom.
