Access to Basement Provided on Demand

The DRA ruled for tenant and ordered landlord to provide access. Landlord appealed, claiming there was no need for tenants to be in the basement. The superintendent lived in the building and provided access on demand. Landlord was concerned about the safety of the heating plant. The DHCR ruled for landlord and revoked the order. Direct individual access to the basement wasn't a required service.
