Wooden Boards Placed at Curbside

DOS issued a violation notice to landlord for placing loose rubbish out for collection. The inspector said that there were five pieces of untied and unsecured wooden boards placed at curbside. Landlord objected, but the ALJ ruled against landlord and fined it $50. Landlord appealed, again claiming that a tenant or passerby placed the loose rubbish out during the night. The ECB ruled against landlord. Even if tenants placed these items at the curb, landlord was responsible for what was left out in front of its building.
