Violation Against Wrong Condo Owner for Short-Term Rental Dismissed

DOB issued a violation notice to a condominium unit owner for illegally using a Class "A" multiple dwelling unit for transient use. The unit owner testified that he didn't own Apartment A1R, which was the unit identified in the violation. DOB's inspector testified that he interviewed transient occupants in Apartment A1R. But the owner charged owned only Apartment A1A. The ALJ dismissed the violation. DOB appealed and lost. DOB failed to prove that the unit owner to whom it had issued the violation had violated the law.
