Vacancy Rent Wasn't $2,000 or More

Tenant complained of a rent overcharge. His first rent in September 1993 was $2,250. Landlord claimed that the apartment was no longer subject to rent stabilization. The DRA ruled for tenant, finding that the prior tenant's rent was $1,600 and that the next legal rent was less than $2,000. Landlord appealed. The DHCR ruled against landlord. Claimed apartment improvements didn't cost enough to warrant a 1/40th increase that would put the new legal rent over $2,000 per month.
