Landlord sued to evict tenant's son after tenant moved out, claiming that the son was an illegal subtenant. Tenant's son claimed pass-on rights. The court ruled for landlord. Tenant's son appealed and lost. There was no proof that tenant's son lived in the apartment with tenant before tenant moved out. Tenant illegally sublet or assigned the apartment to his son.
