Three Buildings with Common Ownership Are Horizontal Multiple Dwelling

Tenant complained that landlord didn't renew his lease. The DRA ruled against tenant, finding that the building wasn't rent stabilized. The building contained three apartments and a store. Tenant appealed, claiming that the building was connected to two other buildings and, so, was a horizontal multiple dwelling. The DHCR ruled for tenant. Tenant showed that the buildings were attached, were under common ownership and operation, shared one block and lot number, had one oil-burning heating system, and one water main.
