Termination Notice Defective

Landlord sued to evict tenant for non-primary residence. Tenant asked the court to dismiss the case because landlord's termination notice was improper. The court agreed. Landlord sent a notice of termination on June 11, 1991, asking tenant to vacate by July 31. Landlord was required by the Emergency Tenant Protection Act (ETPA) and tenant protection regulations to send the notice of termination between 120 and 150 days before tenant's lease expired.
