Tenants Claim Elevator's Indicator Lights Defective

Landlord applied for MCI rent increases based on elevator upgrading. The DRA ruled for landlord, and tenants appealed, claiming that since the upgrading, the outside and inside elevator indicator lights had been defective. The DHCR ruled against tenants. The DRA properly relied on proof that landlord properly upgraded the elevator, including governmental approval from DOB. Also, there were no rent reductions in effect based on a reduction in services at the time the MCI application was approved.
