Landlord sued to evict tenant for nonprimary residence. The trial court ruled for landlord, and tenant appealed. The appeals court also ruled against tenant. Landlord had shown that tenant had illegally sublet the apartment to a series of subtenants over the years. Tenant also didn't file a New York State or City tax return for the years in question. During that time, she had been going to graduate school in Florida and working there part-time.
