Tenant Paid More Than Registered Rent

Landlord sued to evict tenant for nonpayment of rent. Tenant asked the court to dismiss the case, claiming that landlord had charged her more than the legal rent for her apartment. Tenant produced DHCR records showing that the legal registered rent for her apartment is $243 per month. But landlord had charged her $337 per month in one year, and $475 per month in the second year. Landlord didn't offer any evidence to rebut tenant's claim. The court found that tenant had been overcharged $2,971.
