Tenant Never Responded to Deregulation Petition

Landlord asked the DRA to deregulate tenant's rent-stabilized apartment, based on tenant's high income. The monthly legal regulated rent was $2,000 or more, and, landlord claimed, tenant's annual income was greater than $250,000. The DRA sent tenant a request for verification of household income. Tenant never responded. The DRA ruled for landlord and deregulated the apartment. Tenant appealed, claiming for the first time that she was the only apartment occupant and submitting copies of her tax records. These showed that tenant earned less than $250,000 per year.
