Tenant Lived in Apartment for over 20 Years

LVT Number: 14301

Landlord sued to evict rent-stabilized tenants to recover apartment B for owner occupancy. Tenants were a married couple. Tenant's husband had lived in apartment A next door for over 20 years. Since 1992, both tenants had lived in both apartments A and B as their primary residence. They claimed that the 20-year rule barring owner occupancy eviction of tenants living in an apartment for more than 20 years should apply also to apartment B. The court ruled for tenants and dismissed the case.
