Landlord sued to evict rent-controlled tenant for nonprimary residence. The trial court ruled for landlord, and tenant appealed. The appeals court ruled against tenant. Landlord showed that tenant illegally sublet her apartment, and that she was away from New York City for prolonged periods over many years and at the same time rented an apartment in Prague. Tenant also didn't pay New York City resident taxes.
