Tenant Got Prior Rent Abatement in Housing Court Settlement Agreement
LVT Number: 13438
(Decision submitted by Pamela A. Koplik of the Manhattan law firm of Rosenberg & Estis, P.C., attorneys for the landlord.) Seven tenants complained of reduced building-wide services. The DRA ruled against tenants. Three tenants had withdrawn their complaint. One tenant had moved out, and the DRA wasn't able to get information needed to process the case with regard to this tenant. The other three tenants had signed an agreement in housing court by which they got a rent abatement for the same conditions. Under the Rent Stabilization Law, as amended by the Rent Regulation Reform Act of 1997, tenants can't get a DHCR rent reduction if they've already gotten a rent abatement in court for the same conditions.
