Tenant Got Copy of Landlord's Application

Landlord applied for MCI rent increases based on the installation of a new roof. The DRA approved landlord's application, and tenant appealed. She claimed she never got a copy of landlord's application while it was pending before the DRA. The DHCR ruled against tenant. Landlord certified that it had mailed or delivered copies of its MCI application to all tenants in the building. Landlord also placed a copy of the application in its management office for tenant inspection. A copy of landlord's rent roll submitted with its application listed tenant's name and apartment number.
