Tenant Filed Fair Market Rent Appeal on Time

Tenant objected to landlord's initial 1984 rent registration. Tenant claimed that the initial registered rent wasn't a fair market rent. The DRA dismissed tenant's complaint, finding that tenant's complaint was filed too late. It wasn't filed within 90 days of Jan. 1, 1979, the local effective date of the Emergency Tenant Protection Act (ETPA). Tenant appealed, and the DHCR reopened the case. Tenant had 90 days from receipt of the initial rent registration in 1984 to file a fair market rent appeal.
