Tenant Evicted for Overcharging Subtenant

Landlord sued to evict rent-stabilized tenant for overcharging subtenant, in violation of Rent Stabilization Code Section 2525.6(b). The court ruled for landlord and issued an eviction warrant. Tenant appealed and lost. At trial, landlord proved that tenant substantially overcharged subtenant by collecting nearly three times the stabilized rent and failing to refund the overcharge. Eviction was delayed 60 days to give tenant time to move.
