Tenant sued landlord in small claims court to recover his security deposit after he moved out of an apartment. The court in Rockland County ruled for tenant, awarding him $1,450. Landlord appealed, and the appeals court sent the case back for a new trial. Tenant had damaged landlord's vanity top, and a trial was needed to determine the cost of installing a new one. This amount would be deducted from tenant's security deposit.
