Tenant Covered by Loft Law

Landlord sued to evict loft tenant after tenant's two-year lease expired. Tenant claimed loft was in an interim multiple dwelling (IMD) subject to rent stabilization under the Loft Law. The court ruled for tenant, and landlord appealed and lost. Landlord rented the commercial loft in an IMD to tenant for residential purposes without getting a residential C of O and with a lease provision permitting tenant to convert the loft to comply with residential code requirements.
