Tenant filed a fair market rent appeal. The DRA ruled against tenant, finding that she wasn't eligible to file. Tenant appealed and lost. A prior rent-controlled tenant moved out of the apartment in 1972. That vacancy occurred between July 1, 1971, and June 30, 1974, during a period of statutory vacancy destabilization. The apartment became subject to rent stabilization under the ETPA on July 1, 1974, and by law wasn't subject to a fair market rent appeal.
