Tenant Can Conduct Pretrial Questioning in Owner-Occupancy Case

Landlord sued to evict rent-stabilized tenant in order to recover the apartment for owner occupancy. The court granted tenant's request to conduct pre-trial questioning. Information sought concerning landlord's good faith intention was relevant to the case and was within landlord's possession or knowledge. An owner seeking a rent-stabilized apartment for personal use had to show a good faith intent to occupy the apartment.
