Tenant Agreed to Improvements, but Not Rent Increases

Tenant complained of a rent overcharge. The DRA ruled for tenant. Landlord appealed, claiming that he was entitled to a 1/40th rent increase for apartment improvements. The DHCR ruled against landlord. Tenant had agreed to have the improvements made, but never signed a written consent for a rent increase. So landlord couldn't collect a 1/40th rent increase.
