Tenant Acknowledged Receipt of DC-2 Notice

Tenant filed a fair market rent appeal. The DRA ruled for tenant and reduced the apartment's first stabilized rent. Landlord appealed, claiming that tenant's complaint was untimely. Landlord had submitted a copy of a ``DC-2'' notice stating the amount of the first stabilized rent and advising tenant of the right to file a fair market rent appeal within 90 days. Tenant's signature appeared on the DC-2 form with his statement that he acknowledged receipt of the form in March 1975. Co-tenant wife had filed the fair market rent appeal in 1984. So the complaint was dismissed as untimely.
