Super Didn't Provide Access to Public Areas

The DRA denied landlord's application for 1990/91 MBR increases because landlord didn't meet the violation certification requirements necessary to get the rent increases. Landlord appealed, claiming that the violations in question had been cleared. But landlord hadn't proved this. The DRA sent an inspector to the building at landlord's request. Apparently, landlord's superintendent didn't expect the inspection because the super didn't provide the inspector access to some of the public areas where the conditions in question were located.

Landlord appealed, claiming that the violations in question had been cleared. But landlord hadn't proved this. The DRA sent an inspector to the building at landlord's request. Apparently, landlord's superintendent didn't expect the inspection because the super didn't provide the inspector access to some of the public areas where the conditions in question were located. So the DRA couldn't determine whether a number of the outstanding violations had in fact been cleared. Landlord's PAR was dismissed.
