Subtenant of Nonprofit Organization Must Vacate with Tenant

Subtenant complained to the DHCR that she was entitled to a lease renewal after tenant advised her that it would not renew her sublease. The DRA ruled against subtenant and dismissed the complaint. The tenant, Community Access, Inc., was a nonprofit organization that sublet the apartment and subsidized subtenant's rent with funds provided by the Supported Housing Program of the New York State Office of Mental Health. Since landlord wasn't renewing tenant's lease, both tenant and subtenant had to vacate the apartment. Subtenant wasn't entitled to a sublease renewal.
