Section 8 Tenant Not Exempt

Tenant complained of a reduction in services. The DRA ruled for tenant and reduced his rent. Landlord appealed, claiming that since tenant received a Section 8 rent subsidy, his apartment was regulated by HUD and not by rent stabilization. The DHCR ruled against landlord. Landlord's acceptance of a Section 8 subsidy paid on behalf of tenant doesn't remove the apartment from rent regulation.
