Tenant complained of a rent overcharge. Her monthly rent was $240, and she had a rent-stabilized lease. Tenant claimed that she was rent controlled because she had lived in the apartment since 1969. She also claimed that the legal rent was $70 per month. Landlord had filed a report of decontrol in 1975. The DRA ruled for tenant and revoked the decontrol report. Landlord appealed, claiming that tenant didn't live in the apartment, that the apartment had been registered as rent stabilized in 1984, and that tenant had signed repeated renewal leases for the apartment since then.
