Replacement of Thermal Windows Qualifies

Landlord applied for MCI rent hikes based on the installation of new thermal windows. The DRA ruled for landlord and tenant appealed. The DHCR ruled against tenant. Landlord showed that the old windows had outlived their useful life based on wear and tear, developments in new windows, and local climate conditions. The new thermal windows therefore qualified as MCIs.
