Rent-Stabilized Tenant's Daughter Gets Apartment

The daughter of a rent-stabilized tenant complained to the DHCR in 2022 after landlord refused to give the daughter a renewal lease after tenant died in September 2021. The daughter claimed she had succession rights. The DRA ruled for the daughter, finding that she and her son had lived in the apartment for more than two years before tenant died.

The daughter of a rent-stabilized tenant complained to the DHCR in 2022 after landlord refused to give the daughter a renewal lease after tenant died in September 2021. The daughter claimed she had succession rights. The DRA ruled for the daughter, finding that she and her son had lived in the apartment for more than two years before tenant died. The DHCR also found that landlord's inclusion of a washing machine surcharge in recent renewal leases to the tenant was unsupported since the machine had been in the unit for 20 years and landlord didn't indicate when it was discovered.
