Rent Overcharge Complaint Didn't Claim Overcharge

Rent-stabilized tenant filed a rent overcharge complaint that didn't contain any specific overcharge claim. Instead, tenant complained that landlord hadn't offered him a renewal lease and that his apartment wasn't registered. The DRA ruled against tenant, who appealed and lost. Tenant can't complain of rent overcharge for the first time in his PAR. Landlord had filed amended apartment registrations and had notified tenant that he wouldn't renew tenant's lease because he wanted the apartment for landlord's mother.

Landlord had filed amended apartment registrations and had notified tenant that he wouldn't renew tenant's lease because he wanted the apartment for landlord's mother. The DRA also properly ruled that landlord should move forward with the court proceeding for owner occupancy within 30 days or else offer tenant a renewal lease.
