Rent Increase Granted for Window Guards

Landlord applied for MCI rent hikes based on the installation of apartment windows and window guards. The DRA ruled for landlord in part, disallowing any increase for window guards. Landlord appealed. The DHCR again ruled that window guards weren't an MCI. Landlord then appealed to the court and argued that the DHCR's decision was arbitrary and unreasonable. The court ruled for landlord, finding that building-wide window guards were a major capital improvement. The court sent the case back to the DHCR, which then ruled for landlord.
