Rent Frozen at First Stabilized Rent Charged

Tenant complained of a rent overcharge. The DRA ruled against tenant, finding no rent overcharge. Tenant appealed, claiming that the rent should have been frozen at the last rent-controlled rent until landlord filed the initial RR-1 registration form for the apartment in October 1994. The DHCR ruled against tenant. Under the rent stabilization code, not registering only bars landlord from collecting any rent in excess of the legal regulated rent in effect on the date that the apartment became subject to rent stabilization.
