Rent Credit Subtracted from Overcharge

Tenant complained of a rent overcharge. The DRA ruled for tenant and found that the overcharge was willful. Landlord appealed, pointing out that it had given tenant a rent credit of $1,000 while the case was pending. The DHCR ruled for landlord and reduced the overcharge amount by the amount of the rent credit.
