Previous Increase for Windows Deducted from Rent Hike

Landlord applied for MCI rent hikes based on the installation of new windows. The DRA approved landlord's application, but exempted certain tenants from paying the rent increase because they were already paying individual rent increases for new windows. Landlord appealed, pointing out that the four tenants in question had previously received storm windows only. The MCI application was for the installation of prime windows. The DHCR ruled that landlord was entitled to the MCI increase from these tenants minus the prior increase for the storm windows. This was DHCR policy.
