Pointing Was Piecemeal

Landlord applied for MCI rent hikes based on pointing. The DRA ruled against landlord, finding that the pointing was done in a piecemeal manner over a six-year period. Landlord appealed, claiming that pointing done in 1980 was complete, later work done in 1986 was due to deterioration, and all necessary work was done then. The DHCR ruled against landlord. Records showed that the pointing was of a piecemeal and patchwork nature. The 1980 work was not all that was necessary to prevent exterior seepage for a reasonable period of time, since additional work was needed six years later.
