Plumbing Repairs in Tenant's Apartment Disturbed Asbestos

The ALJ ruled that landlord violated city asbestos regulations, and fined landlord $16,000. While repairing a leaky pipe in tenant's apartment closet, landlord's plumber recklessly exposed, handled, and removed asbestos-containing material (ACM). Landlord appealed, and the ECB's appeals unit reduced the fine to $8,000. Landlord was liable for its contractor's work. But, the plumbing work involved was less than 10 square feet and was therefore a minor project. Also, landlord had no previous asbestos violations.
