Peeling Paint Problems Were Minor

LVT Number: 10881

(Decision submitted by James R. Marino of the Manhattan law firm of Kucker Kraus & Bruh, attorneys for the landlord.) Tenants complained of a reduction in building-wide services. The DRA ruled for tenants and reduced rents. Landlord appealed, claiming that the necessary painting work in the building's public areas was completed six months before the DHCR's inspection. The inspector found minor peeling paint and plaster above two apartments, on the staircase walls, and above the elevator doorways of the second and third floors. The DHCR ruled for landlord and revoked the rent reduction.
