One Registration Required for Two Hot Water Heaters with Common Venting

LVT Number: 10896

DEP issued a violation notice to landlord for not registering fuel burning equipment. Landlord claimed that registration of the hot water heater in question wasn't necessary. The ALJ ruled against landlord and imposed a $440 fine. Landlord appealed. ECB ruled for landlord and revoked the fine. The hot water heater shared common venting with a boiler that had been registered with DEP. Separate registration of the hot water heater wasn't required.
