Landlord sued to evict rent-stabilized tenant, claiming that tenant violated a substantial obligation of his tenancy. The trial court dismissed landlord's petition, and landlord appealed. The appeals court affirmed. The Rent Stabilization Code required landlord to send tenant a notice to cure before ending the tenancy. Since landlord didn't do so, its petition was properly dismissed.
