Noise Complaint

Tenant complained of a reduction in services based on excessive noise between floors and apartments. The DRA ruled against tenant and stated that noise complaints should be referred to DOB. Tenant appealed, claiming that DOB told her to complain to DHCR. The DHCR ruled against tenant. Under current DHCR policy, noise caused by another tenant is considered a minor condition that doesn't amount to a reduction in services. But tenant may be entitled to bring a court complaint.
