No Vacancy Increase for Adding Roommate's Name to Lease Without Tenant's Consent

Tenant complained of a rent overcharge. The DRA ruled for tenant. Landlord appealed, claiming that he was entitled to a vacancy increase when tenant's roommate was added to a renewal lease. The DHCR ruled against landlord. Tenant claimed that he never agreed that his roommate should be a cotenant and said that the lease that landlord submitted was fraudulent.
