Tenant claimed that she was rent controlled and asked the DRA to make that determination. The DRA ruled against tenant. She appealed and lost. Tenant initially resided in the apartment with her mother and grandmother. Tenant's grandmother owned the building from 1911 to 1960. When the grandmother moved out, the apartment was owner-occupancy decontrolled. Since there were fewer than six apartments in the building, the apartment never became rent stabilized. So tenant wasn't subject to rent regulation.
