No MCI Rent Hike for Retaining Wall

Landlord applied for MCI rent hikes based on pointing and waterproofing, a new roof, and the installation of a new retaining wall. The DRA ruled for landlord in part, but disallowed any increase for the retaining wall because it didn't qualify as an MCI. The DHCR denied tenant's appeal, which raised repair issues not previously presented to the DRA.
