No Increase for Roommate Who Is Tenant's Life Partner

Landlord asked the DHCR for permission to increase rent-controlled tenant's rent based on the fact that tenant had a roommate. The DRA ruled against landlord. Landlord appealed and lost. Tenant showed that his roommate was his gay life partner through proof of a long-term financial and legal commitment. Tenant submitted, among other things, life insurance and retirement savings records. Under the rent control regulations, tenant's roommate qualified as a family member and so no rent increase was permitted.
