No IAI Rent Increase Granted for Bathtub Reglazing

Rent-stabilized tenant complained of rent overcharge. The DRA ruled for tenant and ordered landlord to refund $32,825, including triple damages and interest. Landlord appealed and lost. The DRA had excluded a $50 rent increase claimed by landlord for individual apartment improvements (IAIs), finding that the work done was ordinary repair and maintenance. The DRA also properly discounted additional IAIs since landlord failed to prove that bathtub reglazing was an improvement and failed to prove payment.
