No Attorney's Fees for Tenant in Rent Overcharge Case

LVT Number: #25553

Rent-stabilized tenant complained of rent overcharge. The DRA ruled for tenant and ordered landlord to refund the overcharge with interest. Tenant appealed and lost. Tenant pointed out that the DRA’s order listed the base rent date as Nov. 22, 2011, instead of Nov. 22, 2007. This was a typographical error, but the DRA otherwise properly calculated the overcharge during the four-year look-back period. Tenant also asked for attorney’s fees.

But tenant didn’t show that he incurred reasonable costs or attorney’s fees, and wasn’t represented by an attorney in this case.
